PLC decides to implement decision on Abbas's expired term

Ahmed Bahar, first deputy speaker of the Palestinian Legislative Council (PLC), said that the council approved the execution of the decision taken recently by the constitutional court about the expiry of Mahmoud Abbas’s term of office.

In a statement on Thursday, Bahar explained that the Supreme Constitutional Court (SCC) on June 24, 2019 sanctioned the expiry on January 8, 2009 of Abbas’s constitutional mandate as president of the Palestinian Authority (PA) in accordance with the provisions of Article 36 of the 2003 Basic Law and its amendments.

According to the deputy speaker, all the decisions, decrees, actions, orders and illegal practices that have been issued or okayed by Abbas since the expiry of his term of office are null and void and considered as if they do not exist.

He asserted that the PLC would continue to exercise its constitutional mandate and its legislative, supervisory and financial duties until a new council was elected in accordance with the verdict taken in this regard by the SCC and the provisions of Article 47 bis of the Basic Law.

The lawmaker pointed to the need to implement Article 37/2 of the Basic Law to fill the constitutional vacuum, fill the vacancy of PA president’s office, and hold elections for the parliament, the presidency and the national council.

Bahar called on the Arab, Islamic and international parliaments, parliamentary unions, the Arab League, the Organization of Islamic Cooperation, and the international community and its official and legal institutions not to deal with Abbas and observe the legal practice in such case.

He pointed out that the PLC would send messages in this regard to all concerned parties locally, regionally and internationally, pursuant to the principles of justice, democracy and human rights.
